Child Custody: It Can Get Really Messy

Family lawyers deals with the issues and cases regarding family relations such as adoption, child custody and visitation, children’s rights, child support, spousal support (alimony), separation agreements, civilian and military divorce (dissolution of marriage), marital property division (equitable division), elder law matters, estate planning, estates and trusts, wills and will contests, probate, insurance, cohabitation agreements, pre-marital (pre-nuptial) agreements, marriage and other legal issues pertinent to the family. Every family lawyer has his own specialization. And child custody lawyers specialize in cases dealing with the custody of the children.
Every state has a different law dealing with child custody. But, all in all, child custody only defines one purpose which is the welfare of the child. In the UK, child custody law determines who should be responsible for the care of the child and with whom the child should reside with.
Child custody same with child support is one of the issues that follow the divorce of the child’s parents. However, child custody lawyers are not just there during divorce or after. Their advice is very important to the parents of the child. Family lawyers will always put the best interests of the child first.
Even though, the issue of child custody is produced by the divorce, some divorce proceedings can manage fine without the consultation of child custody. This could happen if both parties are cooperating well without any fight and complications in the process. However, this one is a very rare case because the question of why would they file a divorce if they still have a good relationship. Also, some custody battles become difficult and often consist of a number of various accusations being thrown at the other party in a bid to gain full custody of the child.
There are also times in which a parent has no right to have access to his or her child any longer. This could happen, if violence and abuse towards the child is involved. However, the court has still the right to change the decision at any point in time, should the circumstances change.
Here are the three main types of custody than can be agreed by both parties and are often awarded by the courts. First is sole custody. It is where one parent will have physical and legal custody of the child. Second is joint custody. It is where both parents have the legal custody of the child and/or both parents have physical custody of the child. And lastly is the split custody where one parent has full time custody over some of the children and the other has full custody of the other children.
Here are some of the additional types of child custody. First, physical custody refers to the general day-to-day care of a child and where the child lives. Then, joint physical custody refers to which the child lives with his both parents. This means that the child has two homes and shares his time between the two parents. And the other is joint custody. Parenting is shared, thus both parents share the responsibility of day-today decisions.
